Geyser (“Geyser,” “we,” or “the Platform”) is a SaaS service that automates the creation of promotional videos for video game studios, using artificial intelligence for clip selection, script generation, voice, and rendering.
These Terms of Service (“Terms”) govern access to and use of geyser.ink and any related service. For questions about these Terms, you can write to us at support@geyser.ink.
By creating an account, subscribing to a plan, or using the Platform in any way, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use Geyser.
Geyser is a self-service SaaS platform. There is no custom or agency-style service component; all users access the same self-serve subscription plans described in Section 8.
Geyser may be used by individuals 13 years of age or older. If you are under 18, you may only use the Platform under the supervision and with the consent of a parent or legal guardian.
The account, billing, and contractual ownership must always be held by an adult (18 years or older) or by an entity or studio. A minor may not be the holder of the account or of the payment methods, even if they use the tool under supervision.
If you are a company or studio, you represent that you have the authority to bind that entity to these Terms. We reserve the right to request age or ownership verification and to suspend accounts that violate this section.

The service relies on external providers that perform, among others, the following functions: user authentication, payment processing and billing, file storage, cloud infrastructure, and artificial intelligence for video analysis, script generation, voice synthesis, and complementary audiovisual content. We use industry-recognized providers for each of these functions (for example, for authentication and for payments), and we may change infrastructure or artificial intelligence providers at any time without this requiring an update to these Terms, unless the change materially affects your rights, in which case we will notify you as set out in Section 23.
To provide you the service, your User Content and certain data associated with your account are transmitted to infrastructure and artificial intelligence providers that may be located outside Colombia. By using Geyser, you expressly authorize such international transfer and transmission of data, in accordance with Law 1581 of 2012 and our Privacy Policy, understanding that these providers are subject to their own terms and privacy policies, over which Geyser does not have full control.
We may modify, replace, or add new infrastructure or artificial intelligence providers at any time, notifying material changes as set out in Section 23.
You are responsible for maintaining the confidentiality of your credentials and for all activity carried out from your account. You must provide truthful information when registering and keep it up to date.
We reserve the right to suspend or close accounts that violate these Terms, that show fraudulent activity, or that put the security of the Platform or of third parties at risk.
We may use independent contractors, development providers, or external services to operate, maintain, or improve the Platform, who may have limited technical access to infrastructure or data necessary for that purpose. In such cases, we will require these third parties to accept confidentiality and data-protection obligations reasonably equivalent to those assumed by Geyser in its Privacy Policy.
Access to certain features may require payment of a subscription or fee, processed through an external payment provider. Prices, billing cycles, and refund policies in effect will be indicated at the time of purchase.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing cycle (monthly or annual, depending on the plan), charging the same payment method on file, unless you cancel before the renewal date from your account dashboard or by writing to support@geyser.ink. We will notify you by email with reasonable advance notice before each renewal when applicable law requires it, and in any case before any price change.
Credits. The use of certain features (for example, video generation) consumes credits assigned according to your plan (Free, Creator, Studio, or others we may offer). Unused credits do not roll over between billing cycles, reset with each confirmed renewal of the period, are not transferable to another account or redeemable for cash, and do not entitle you to a refund except for an error attributable to Geyser in their allocation or consumption.
Free plan. The free plan, where available, may include limited credits and restricted features. We may modify, limit, or discontinue the free plan at any time, without prior notice, without this giving rise to any right of compensation.
You are responsible for maintaining valid payment methods and for taxes applicable in your jurisdiction.
Users in Colombia. Under Law 1480 of 2011 (Colombian Consumer Protection Statute), the right of withdrawal cannot be waived in advance by contract. However, the law itself recognizes that this right does not apply to services whose performance has begun with the consumer’s prior, express agreement (Article 47, paragraph 1), including the consumption of digital content begun with such consent. By confirming a purchase of credits or a plan and requesting the generation of a video, you give your prior, express consent for performance of the service to begin immediately. Accordingly, once generation of content or consumption of credits associated with that specific transaction has begun, the right of withdrawal will not apply to that transaction, without prejudice to your right to exercise it over credits or features not yet used, within the legal term of five (5) business days.
Users in the European Union. By confirming your purchase and requesting immediate delivery of digital content, you acknowledge and agree that you lose the fourteen (14) calendar day right of withdrawal with respect to that content once its performance has begun with your express consent, in accordance with applicable European consumer protection law.

“User Content” refers to the clips, images, text, scripts, and any material you upload to Geyser.
You retain ownership of your User Content. You grant us a worldwide, non-exclusive, limited license to use, process, store, and transform that content solely to provide you the service (for example, sending it to artificial intelligence providers to generate the requested video).
You represent and warrant that you hold the necessary rights over the User Content you upload (including image, music, trademark, and game-asset rights) and that its use does not infringe third-party rights.
Your own gameplay recordings. Geyser is designed for content you have personally recorded while playing your own game or a game you are authorized to promote (for example, screen recordings of your own gameplay sessions, in the same way you would record footage to upload to YouTube or TikTok). You represent that the clips you upload are recordings you made yourself or that you otherwise have the right to use and publish. Geyser does not accept or process footage, assets, or files copied directly from a third party’s files or servers without your own recording or authorization.
Voice narration. Geyser’s AI voice features are intended solely for generating narration in AI-selected voices provided by the Platform, or for processing audio that you recorded yourself. Geyser does not offer voice cloning of streamers, voice actors, or any other identifiable third party, and you must not attempt to upload third-party voice recordings for the purpose of cloning or impersonating them.
Stickers and graphic elements. Generated videos may automatically incorporate stickers or animated graphics selected through artificial intelligence. These elements come exclusively from licensed sticker libraries that Geyser integrates under its providers’ license terms, and are made available to you for use within videos generated on the Platform. You must review the generated video before publishing or using it commercially.
You must not upload illegal content, content that infringes third-party intellectual property rights, content containing unnecessary sensitive personal data, or content that violates these Terms.
Videos, scripts, and narrations generated through Geyser are produced with the assistance of third-party artificial intelligence models. AI-generated results may contain errors, inaccuracies, or unintentional similarities to other works. You must review generated content before publishing or using it commercially.
We do not guarantee that the generated content is exclusive, free from third-party claims, or suitable for every commercial purpose. We also do not guarantee that such content is free from violations of third-party distribution platforms’ terms of use (for example, TikTok or YouTube), and we assume no responsibility for penalties, takedowns, or sanctions applied by those platforms on your own channels.
No performance guarantee. Geyser does not guarantee views, reach, engagement, click-through rate, revenue, conversion, or any other performance outcome resulting from publishing the generated content. Results depend on factors outside our control, including the algorithms of distribution platforms.
Not legal advice. Geyser does not provide legal advice. Reviewing whether generated content is suitable for a specific commercial use, or complies with regulations applicable to your activity, is your responsibility.
Subject to the rights of the underlying AI providers, the final output generated for your project belongs to you, once the corresponding subscription or credits have been paid for.

We may suspend access immediately in the event of a serious violation of this section.
The software, brand, design, documentation, and other elements of the Platform (excluding User Content and the content generated for you) are owned by Geyser or its licensors. Nothing in these Terms grants you any rights over those elements, other than the limited right to use the Platform under these Terms.
We work to keep the Platform available, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes to features at any time, seeking to give reasonable notice when possible.
We will not be liable for delays or failures resulting from causes beyond our reasonable control, including failures or interruptions of third-party infrastructure or artificial intelligence providers, connectivity outages, natural disasters, government actions, or any other event of force majeure. In such cases, we will work to restore the service and communicate about it reasonably.
We implement reasonable technical and organizational measures to protect your User Content and personal data. However, no system is completely secure.
If we detect a security incident that compromises personal data or User Content, we will notify you without undue delay, and we will inform the competent authority (in Colombia, the Superintendence of Industry and Commerce) when required by law. This clause does not replace or limit the more detailed obligations described in our Privacy Policy.
Geyser is provided “as is” and “as available.” To the maximum extent permitted by law:
Exceptions to this limitation. None of the above limitations apply in cases of fraud, willful misconduct, or gross negligence on Geyser’s part, or to liabilities that cannot be limited under applicable law (including, as applicable, consumer rights under Colombian or European law).
You agree to hold Geyser harmless against third-party claims arising from: (i) your User Content, including material you did not have the right to upload or publish, (ii) your breach of these Terms, or (iii) your misuse of the Platform.
You may stop using Geyser and request closure of your account at any time. We may suspend or terminate your access if you breach these Terms, as required by law, or due to discontinuation of the service, notifying you when reasonably possible.
Content after closure. Once an account is closed, we will retain your User Content and generated videos for thirty (30) calendar days, during which you may request their export. After that period, we will permanently delete them from our active systems, except as required by law or residual backup copies, which will be deleted according to our ordinary retention cycles, described in the Privacy Policy.
We may assign or transfer these Terms, together with the rights and obligations arising from them, in connection with a merger, acquisition, corporate restructuring, or sale of Geyser’s assets, without needing your prior consent, provided the assignee assumes the obligations set out here toward you. We will notify you of any such assignment when reasonably possible. You may not assign your rights or obligations under these Terms without our prior written consent.
If any provision of these Terms is found invalid, illegal, or unenforceable by a competent authority, that provision will be deemed severed from the rest, without affecting the validity and enforceability of the remaining provisions, which will remain in full force.
These Terms are primarily governed by the laws of the Republic of Colombia, including Law 1581 of 2012 on personal data protection and Law 1480 of 2011 (Consumer Protection Statute), to the extent applicable to users acting as consumers.
For users located in the European Union, the provisions of the General Data Protection Regulation (GDPR) and applicable European consumer protection law will also apply. For users located in the United States, applicable state data protection laws in the user’s state of residence will apply, as relevant, without prejudice to the governing law set out in this section.
Any dispute will first be submitted to a good-faith attempt at direct resolution between the parties, and failing that, to the competent courts under applicable law.
We may update these Terms from time to time. If changes are material, we will notify you by email or through a notice on the Platform. Continued use of Geyser after such notice constitutes acceptance of the updated Terms.
